Texas executed a man sentenced to death by lethal injection on Wednesday. It was the first execution in the United States since the failed attempt to execute Christa P. in Tennessee.
Jamaal H. was put to death at the state prison in Huntsville. According to the Associated Press (AP), he was pronounced dead at 8.03pm local time after receiving pentobarbital. The execution was challenged earlier that day, but the courts did not intervene.
The case is attracting extra attention because H. was the first prisoner to be executed in the United States since the attempt to put Christa P. to death in Tennessee on 30 September failed. According to her lawyers, P. received two doses of the same drug and was then taken to hospital. She is now conscious and able to speak, but her further recovery remains uncertain.
After the failed procedure, the authorities in Tennessee announced an independent investigation. It is also still unclear whether the state will try to execute P. again. Legal scholars disagree on whether such a second attempt would be legally possible, especially because the lethal drug was actually administered.
H.'s lawyers had pointed to possible problems with the pentobarbital and argued that he was intellectually disabled. Those arguments did not lead to a postponement. The Texas Department of Criminal Justice had previously placed H. on the list for execution on 7 October.
The execution means that the death penalty remains active in parts of the United States, despite the debate over execution methods, medical risks and whether a condemned person remains mentally fit to be executed. Texas has two more executions scheduled for later this year. P.'s case could further sharpen the legal debate over them.
