A court in Rio de Janeiro ended the court-supervised restructuring proceedings of Brazilian retail chain Americanas on Monday. The company came under court protection in 2023 after billions in accounting irregularities came to light.
The decision was taken by Rio de Janeiro's fourth commercial court. According to the ruling, the group has met the obligations set out in the approved restructuring plan. The decision can still be appealed.
Americanas sought protection from creditors in January 2023. At the time, the company reported debts of approximately 43 billion Brazilian reals. Around the same period, accounting irregularities worth approximately 20 billion reals were disclosed, severely damaging the confidence of investors, suppliers and customers.
The restructuring plan was approved in December 2023 and ratified by the court in February 2024. The court-supervised proceedings gave the company room to restructure its debts and continue operating. According to the ruling, the new decision removes the designation that the companies are undergoing court-supervised restructuring from the official registers.
The end of the proceedings does not mean that all legal issues have been resolved. According to the court, creditors can still object or seek enforcement of obligations under the plan. In certain circumstances, they may even apply to open bankruptcy proceedings again.
Americanas describes the end of the proceedings as an important milestone and speaks of a new phase for the company. That wording comes from a company statement and says nothing yet about its longer-term financial health.
For Brazil's retail sector, the ruling is primarily a test of whether a large company can return through restructuring after an accounting scandal. The proceedings affect creditors, suppliers and employees, but the sources consulted contain no new figures on revenue, profit or employment.
The case is therefore more than a corporate announcement. It shows that ending court-supervised restructuring is a legal turning point, but not an automatic waiver of all obligations or a guarantee of sustainable recovery.
