A South Korean court on Friday acquitted Seoul mayor Oh Se-hoon in a case concerning prohibited political funding. For now, that removes the risk that he would have to step down.

The Seoul High Court overturned Oh’s conviction by a lower court. That court had previously fined him 10 million won. A final conviction with a fine of at least 1 million won could cost him the mayoralty, according to Yonhap.

The case concerned opinion polls allegedly provided to Oh before the 2021 mayoral election. Prosecutors said a businessman paid for polls conducted for Oh. Oh denied ordering the polls or knowing about the payment.

The court ruled that the evidence was not sufficiently reliable for a conviction. South Korean media reported that the court had doubts about the statements of a political intermediary who played an important role in the case.

The ruling has consequences for Oh’s political position. He remains mayor of Seoul and, according to Yonhap, is once again being mentioned as a possible candidate for higher national office. According to Yonhap, the governing and opposition parties responded differently to the ruling; the opposition welcomed it, while the governing party, according to Yonhap, called for an appeal.

The case shows how legal proceedings in South Korea can have a direct impact on national politics. The acquittal is an appellate ruling; further legal steps may still follow.

  • The lower court had previously convicted him.
  • The case concerned opinion polls and political funding.
Centre

Arguments An independent judge must decide on the basis of reliable evidence. At the same time, parties should clarify campaign-finance rules so that similar cases do not rest mainly on witness statements.

Values Legal certainty, independent institutions and administrative continuity.

Consequences The ruling keeps the city governable, while better rules could limit future uncertainty.

Right

Arguments An elected official should not be removed from office because of a questionable or insufficiently proven case. From this right-wing perspective, legal proceedings should not be used as a substitute for elections; the acquittal in itself does not prove that this happened.

Values Democratic legitimacy, due process and state restraint.

Consequences A high evidentiary threshold protects elected officials, but may prompt criticism if voters are given insufficient insight into campaign financing.

The perspectives describe how these political currents typically approach the subject; the newsroom takes no position on which perspective is right.
